The City of Bath wishes to announce an update to the Single Use Carry-Out Bags Ordinance (2017) which will go into effect on May 22, 2019. The current Ordinance states that:
“A store may make available for sale to a customer a single-use paper carryout bag for a mandatory, minimum charge of five cents ($0.05) per bag. The charge will increase to ten cents ($0.10) per bag one year after this ordinance takes effect. The charge will increase to fifteen cents ($0.15) per bag two years after this ordinance takes effect” (Refuse Ordinance, Cap 13 § 65 (2017)).
The charge increase to ten cents ($0.10) per bag took place on April 22, 2019. However, a recent amendment to this ordinance will make the fee entirely optional for business owners. Beginning May 22, 2019, Bath businesses may choose either to establish their own fee for single-use paper carryout bags or discontinue charging a fee entirely. In addition, the provisions for signage and receipt itemization are also eliminated.
Please note that this does not change the Ordinance’s prohibition on single use carryout bags made of plastic.
